TCPA Disclosure and Consent Policy

1. 1. What Is the TCPA?

The Telephone Consumer Protection Act of 1991 (47 U.S.C. § 227) and its implementing regulations (47 C.F.R. § 64.1200) restrict telemarketing calls, autodialed calls, pre-recorded messages, and SMS/MMS text messages to consumer telephone numbers. PrimeHelpNetwork fully complies with the TCPA, the FCC's 2023 "one-to-one consent" rule, the FTC's Telemarketing Sales Rule (16 C.F.R. Part 310), the CAN-SPAM Act (15 U.S.C. §§ 7701–7713), the National Do Not Call Registry, and applicable state telemarketing, privacy, and "mini-TCPA" laws (including Florida's FTSA, Oklahoma's TCPA, Washington's CEMA, and California's CCPA/CPRA where applicable).

3. 3. Exact Consent Language Used on All Forms

"By submitting this form, you expressly consent to be contacted by PrimeHelpNetwork and its licensed partner network by phone, email, and/or SMS text message, including through automated dialing technology, artificial or pre-recorded voice messages, and SMS/MMS, at the telephone number and email address provided, even if such number is on a federal, state, or company Do Not Call list. You may revoke consent at any time by replying STOP to any text, saying STOP on any call, or submitting an opt-out request through our online contact form."

4. 4. One-to-One Consent (FCC 2023 Rule)

Consistent with the FCC's December 2023 ruling closing the "lead generator loophole," each consent collected on this Site applies only to PrimeHelpNetwork and a single category-specific Partner reasonably expected to fulfill the consumer's request. We do not transfer consent to unrelated marketers or unrelated categories.

5. 5. Consent Documentation & Retention

For each submission we securely store:

  • Timestamp (UTC, to the millisecond) of the form load and submission.
  • IP address, user-agent string, device type, and session identifier.
  • Landing page URL, page title, UTM parameters, and referring URL.
  • The exact disclosure language displayed at the time of consent.
  • The full set of form field values submitted.
  • ActiveProspect TrustedForm certificate URL where available.

Consent records are retained for a minimum of five (5) years from the date of consent or last contact, whichever is later.

6. 6. Opt-Out Instructions

You may revoke consent and opt out at any time, by any reasonable method, including:

  • Replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message.
  • Saying STOP or DO NOT CALL on any phone call.
  • Clicking the unsubscribe link in any email.
  • Submitting an opt-out request through our online contact form (select "Opt-out / Do Not Contact").

Opt-out requests are honored immediately and, in any event, no later than ten (10) business days as required by the TCPA. If a Partner contacts you after you have opted out with us, please notify us and we will facilitate suppression with that Partner.

7. 7. National Do Not Call Registry & Internal DNC List

We honor the National Do Not Call Registry maintained by the Federal Trade Commission and maintain an internal, company-wide Do Not Call list updated daily. Numbers added to our internal list are suppressed across all Partners. To be added to our internal list, use our online contact form and provide your name, phone number, state, and any email address used.

8. 8. Minors

The Site is not directed to children under 18. We do not knowingly collect contact information from, or send marketing communications to, minors.

9. 9. Calling Times

Marketing calls and texts are made only between 8:00 a.m. and 9:00 p.m. local time at the consumer's location, consistent with FTC and FCC rules. Some state laws impose narrower windows, which we also honor.

10. 10. Compliance Monitoring

PrimeHelpNetwork conducts ongoing TCPA, telemarketing, and data-quality audits of itself and its Partner network, including consent verification, suppression list synchronization, and call-monitoring spot-checks. Material non-compliance results in suspension or removal from the network.
